Subject:- Action to be taken to fill up the vacancies on the basis of latest Recruitment Rules for the post of Postman and Mail Guard.



Sir/Madam,



I am directed to forward herewith a copy of Recruitment Rules for the posts of Postman and Mail Guard dated 16th December, 2010 gazette notified on 20th December, 2010. It my be observed that the notified Recruitment Rules provide to fill up the vacancies as under (For full text please refer to the Recruitment Rules): Postman:



a) 25% by promotion by selection-cum-seniority of Multi Tasking Staff.



b) 25% on the basis of Limited Departmental Competitive Examination by promotion from amongst Multi Tasking Staff failing which by direct recruitment.





c) 25% by direct recruitment on the basis of Competitive Examination limited to Gramin Dak Sevaks failing which by direct recruitment of Gramin Dak Sevaks (without any examination on the basis of their seniority subject to their meeting the prescribed requirements)

d) 25% by direct recruitment from open market.



Mail Guard



a) 25% by promotion by selection-cum-seniority of Multi Tasking Staff of the recruiting Division.



b) 25% on the basis of Limited Departmental Competitive Examination by promotion from amongst Multi Tasking Staff of the recruiting Division, failing which by direct recruitment.



c) 25% by direct recruitment on the basis of Competitive Examination limited to Gramin Dak Sevaks failing which by direct recruitment of Gramin Dak Sevaks (without any examination on the basis of their seniority subject to their meeting the prescribed requirements).d) 25% by direct recruitment from open market with matriculation as minimum qualification.



2. It is presumed that the Circles have already filled up the vacancies of Postman and Mail Guard up to the year 2010. The Circles may intimate the number of vacancies pertaining to the year 2010 in the said cadres filled up by them. The number of vacancies of the years 2005, 2006, 2007 and 2008 cleared under ADRP and all the vacancies of the years 2009 & 2010 if any, not yet filled up by any Circle may be communicated to the Directorate along with the reason for the same and the date by which those vacancies would be filled up. The information in this regard may be furnished latest by 7th February, 2011.





3. In order to initiate action to fill up the vacancies of the year 2011 the Circles may work out the firm anticipated vacancies which would fall under various modes of filling up as provided in the Recruitment Rules. Wherever applicable, the vacancies may be assessed Division/Unit wise. The direct recruitment vacancies not cleared under Annual Direct Recruitment Plans of the years 2005, 2006, 2007 and 2008 should not be taken in to consideration while assessing the vacancies.





4. The consolidated number of vacancies so assessed by them for whole Circle may be furnished to the Directorate by 1st Marcy, 2011 positively in the enclosed proforma.



5. Once the Circles complete the process of identification of vacancies to be filled up by various modes they may proceed further to fill up the following vacancies:



(a) Postman: 25% by promotion by selection-cum-seniority of Multi Tasking Staff.



(b) Mail Guard 25% by promotion by selection-cum-seniority of Multi Tasking Staff.



6. The Circles are requested to process the above said appointments in such time-frame so that the appointment orders are issued by 29th March, 2011







7. As regard the vacancies to be filled up by Departmental Examination and direct recruitment, the Directorate is in the process of finalizing the syllabus and scheme for examination. The same will be conveyed to the Circles shortly to enable them to fill up those posts also.

Vacancies in Circle and Administrative Offices:



i.(a) 25% by appointment of Casual Labourers conferred with temporary status on the basis of selection-cum-seniority failing which by,





(b) Appointment of existing Casual labourers engaged on or before 1.9.1993 working, for full hours viz. 8 hours, on the basis of selection-cum-seniority failing which by,

(c) Appointment of existing part-time Casual Labourers, engaged on or before 1.9.1993, on the basis of selection-cum-seniority failing which by,(d) Direct recruitment as per the scheme circulated by the Department of Posts form time to time.

ii. 75% by direct recruitment as per the scheme circulated by the Department of Posts from time to time.



Vacancies in Subordinate Offices:



i) 50% by direct recruitment from amongst Gramin Dak Sevaks of the recruiting Division or Unit, on the basis of selection-cum seniority.





ii) (a) 25% by direct recruitment of the basis of Competitive Examination restricted to the Gramin Dak Sevaks of the Division or Unit failing which by,



(b) Direct recruitment from amongst Gramin Dek Sevaks of the recruiting Division or Unit, on the basis of selection-cum-seniority.





iii) (a) 25% by appointment of Casual Laborers conferred with temporary status on the basis of selection-cum-seniority failing which by.





(b) Appointment of Casual Laborers conferred with temporary status in the neighboring Division or unit on the basis of selection-cum-seniority failing which by,

Wherever applicable the vacancies may be assessed Division/Unit wise. The direct recruitment vacancies of the erstwhile Group 'D' not cleared under Annual Direct Recruitment Plans of the years 2005, 2006, 2007 and 2008 should not be taken in to consideration while assessing the vacancies.





3. The vacancies so assessed may please be furnished to the Directorate by 10th February, 2011 positively in the enclosed proforma.



4. Once the Circles complete the process of identification of vacancies to be filled up by various modes they may proceed further to fill up the following vacancies:

Stepping up of pay of the promotee senior with direct recruited junior appointed on or after 01.01.2006

Subject: - Stepping up of pay of the promotee senior with direct recruited junior appointed on or after 01.01.2006





This is regarding stepping of pay of promotee senior with reference to direct recruit junior appointed on or after 01.01.2006.





2. The issue was examined in this office and referred to Ministry of Finance for clarification. Ministry of Finance Department of Expenditure Legal Cell vide U.O. No. 18/28/2010-Legal dated 29.12.2010 has clarified that the stepping up of pay of the promotee senior with direct recruited junior appointed on or after 01.01.2006 may be agreed to subject to fulfillment of the following conditions: -



(a) Stepping up of the basic pay of seniors can be claimed only in the case of those cadres which have an element of direct recruitment and in cases where a directly recruited junior is actually drawing more basic pay than the seniors. In such cases, the basic pay of the seniors will be stepped up with reference to the basic pay of the directly recruited junior provided they belong to the same seniority list for all purposes.



(b) Further, Government servants cannot claim stepping up of their revised basic pay with reference to entry pay in the revised pay structure for direct recruits appointed on or after 01.01.2006 as laid down in Section II of part A of First Schedule to the CCS (RP) Rules, 2008, if their cadre does not have an element of direct recruitment or in cases where no junior is drawing basic pay higher than them.



(c) Stepping up of pay of the seniors in accordance with the present advice of this Department shall not be applicable in cases where direct recruits have been granted advance increment at the time of recruitment.



3. The issues prevailing in the Circles may be decided as per above clarifications.

Extracts of provisions in FR 56


F.R. 56(a) Except as otherwise provided in this rule, every

Government servant shall retire from service on the afternoon of the last day

of the month in which he attains the age of sixty years:

Provided that a Government servant whose date of birth is the first of

a month shall retire from service on the afternoon of the last day of the

preceding month on attaining the age of sixty years.

Provided further that a Government servant who has attained the age

of fifty-eight years on or before the first day of May, 1998 and is on

extension in service, shall retire from the service on expiry of his extended

period of service.

Or on the expiry of any further extension in service granted by the

Central Government in public interest, provided that no such extension in

service shall be granted beyond the age of 60 years.

(b) A workman who is governed by these rules shall retire

from service on the afternoon of the last day of the month in which he

attains the age of sixty years.

(bb) The age of superannuation in respect of specialists included in

the Teaching, Non-Teaching and Public Health Sub-cadres of Central Health

Service shall be 62 years.

"Provided that for the specialist included in the Teaching sub-cadres

of the Central Health Service who are engaged only in teaching activities

and not occupying administrative positions, the age of superannuation shall

be sixty-five years:

provided further that such specialist of the Teaching Sub-cadres of

Central Health Service who are occupying administrative positions shall

have the option of seeking appointment to the teaching positions in case they

wish to continue in service up to sixty-five years."

(bbb) The age of superannuation in respect of nursing teaching faculty

with M.Sc in Nursing in the Central Government Nursing Institutions shall

be 65 years subject to the condition that they continue to function as faculty

members after the age of 60 years.

(c) Deleted.

(cc) Deleted

(d) No Government servant shall be granted extension in service beyond the

age of retirement of sixty years:

Provided that a Government servant dealing with budget work or

working as a full-time member of a Committee which is to be wound up

within a short period of time may be granted extension of service for a

period not exceeding three months in public interest;

Provided further that a specialist in medical or scientific fields may be

granted extension of service up to the age of sixty-two years, if such

extension is in public interest and the grounds for such extension are

recorded in writing:

Provided also that an eminent scientist of international stature may be

granted extension of service up to the age of 64 years, if such extension is in

public interest and the grounds for such extension are recorded in writing.

Provided also that notwithstanding anything contained in any rule, the

Central Government may, if considered necessary in public interest so to do,

give extension in service to a Cabinet Secretary in the Central Government

for such period or periods as it may deem proper subject to the condition that

his total term as such Cabinet Secretary does not exceed four years.

Provided also that the Central Government may, if considers

necessary in public interest so to do, give extension in service to the

Defence Secretary, Foreign Secretary, Home Secretary, Director,

Intelligence Bureau, Secretary, Research and Analysis Wing and Director,

Central Bureau of Investigation in the Central Government for such period

or periods as it may deem proper on a case-to-case basis, subject to the

condition that the total term of such Secretaries or Directors, as the case may

be, who are given such extension in service under this rule, does not exceed

two years.

Provided also that notwithstanding anything contained in the fifth

proviso, the Central Government may, if considers it necessary, in public

interest, so to do, give an extension in service for a further period not

exceeding three months beyond the said period of two years to the Home

Secretary and the Defence Secretary.

Provided also that, the Central Government may, if considered

necessary in public interest so to do, give extension of service to the

Secretary, Department of Space and the Secretary, Department of Atomic

Energy, for such period or periods as it may deem proper subject to a

maximum age of 66 years.

Provided also that the Appropriate Authority shall have the right to

terminate the extension of service before the expiry of such extension by

giving a notice in writing of not less than three months in the case of a

permanent or a quasi-permanent Government servant, or, of one month in

the case of a temporary Government servant, or pay and allowances in lieu

of such notice.

Govt. moots proposal to enhance educational standards


Govt moots proposal to enhance educational standards



New Delhi, Jan 17 (PTI) Government today mooted a proposal for an "institutional framework" to strengthen Centre-state collaboration in raising educational standards under the RTE regime with the involvement of key education regulators.



Such a framework would include educational bodies like NCERT, State Councils of Educational Research and Trainings (SCERT), CBSE, Council of Boards of School Education in India (COBSE) and National Council for Teacher Education (NCTE).



The proposal was mooted by HRD Minister Kapil Sibal at the meeting of central and state education regulatory bodies with an aim to ensure "constant coordination, continuous flow of information and dialogues between them", said an HRD Ministry official.



Sibal also said that the institutional mechanism between NCERT and SCERTs should also work towards developing question banks which could be used by states for their Teacher Eligibility Test.

After detailed discussion with GS and on the demand of members of IP/ASP, following proposal for cadre restructuring has been formulated for submission to directorate. All are requested to go through it and advise if any amendment is required to make it more effective in the interest of IP/ASPs cadre.

IPASP association has been continuously seeking 2nd cadre restructuring for the last 30 years. The second cadre review committee for the purpose was constituted in 1986 and was finalized in the year 1990 to give effect for upgradation of 245 posts of IP & ASP to Supdt. PSS Group “B”. These orders are even having Presidential approval but have not been executed till now. The proposal which has gone several changes in principle is hanging in the files of Directorate since long.

While by some means the general line staff had managed to get upgradation of 1772 posts of HSG II, HSG I without any commensurate increase in responsibility. The Department has also taken care of the interest of the IPoS and they have derived the benefits of 5 periodical cadre reviews from 1981 to 1989.But the worst part of it is that the entire exercise was separately done for other cadres except IP/ASP, thus taking away the basic thrust for simultaneous career planning for all.

Some of the measures proposed by the department like creation of cluster, creation of inspection cells, reorganization of Sub Divisions with simultaneous upgradation of some posts to PSS Gr B to the extent necessary to match the recommendations of Cadre Review Committee have only met a slow death with the proposal ultimately relegated to the cold storage.

The last initiative taken by the Department just before the announcement of 6 CPC has only extended with the advice from MOF to refer the proposal to 6 CPC. It was only a ploy to delay the proposal from reaching its logical end. Though the Deptt has referred to the 6 CPC, the 6 CPC has refrained from even examining the proposal and in Para 3.3.17 of recommendations, it has categorically stated as “the commission as a general rule, has refrained from conducting cadre reviews of individual services. Accordingly demand made by Individual Service associations has not been taken up.”

With the invent of technology on DOP and Consequent upon introduction of new business branches, the Department of Posts is on the verge of conversion into a dynamic organization with projects like changing ambience of the offices, providing good working environment to the staff, providing comfort to potential customers or visitors and various long lasting projects like Digitization of Records, Core Banking, Mail Optimization, Consumer Price Index, Aadhaar Technology, Biometric systems etc. All these projects are being implemented with the support and incessant hard work of IP cadre. Thus it will not be wrong to say that the total responsibility for successful implementing the various innovative schemes has virtually devolved on the IP and ASP. But when it is the question of career progression of the cadre, the file is consigned to back seat.

There has been no upgrading or cadre restructuring of the apex Grade of our cadre. Consequently there is extreme stagnancy and resultant frustration amongst the incumbents of the cadre. Even after acquiring long years of experience and expertise they remain and mostly retire in the ASP cadre. Even the new entrants in the cadre have realised the attitude adopted by the Department towards IP cadre and are therefore, leaving the Deptt and joining other organizations for better prospects.

Now under pressure from other unions, department has set up restructuring committee to look into the career progression of each cadre leaving behind IP cadre. The cadre has been ignored once again. This is the kind of justice delivery system prevalent in Directorate. All these are not only the root cause of frustration amongst the IP cadre but these are also an impediment in effective execution of administrative policies and plan. This is bound to have an adverse impact on the efficiency of the department.

It will be in the betterment of things if cadre restructuring is done in the revised format in view of changed scenario. The IP cadre can now be classified into three categories:

a) General administration: The posts of ASP (HQ) and that of sub divisional heads can be included in this category under the control of SSP/SP (Division) at every division level.

b) Inspection & investigation: This can be given the same shape as suggested by 2nd CRC.

c) Business, technological & allied works: The present incumbent working as System Manager &MEs can be posted as IP(Technology & BD) on the basis of some benchmark to be fixed by department on justifed posts immediately by creating equal number of Post and thereafter IP examination may be fixed for them. They can put under the supervision of SP (HQ) by creating of post of SP (HQ or Tehnology) in each division under cadre review. Under this process the association is ready to forgo 141 post of Postmaster (HSG-I) in case all post of system managers are created in IP line.





9. The association has no problem if 50% of vacancies in the grade of Sr. Postmaster are filled up by promotion of Postmaster Gr.III with 2 years of regular service in the grade including regular service in HSG- I subject to the condition that 6% PSS Group “B” examination is immediately dispensed with. The rest of 50% vacancies may be filled from Inspector Posts with 6 years of regular service in the grade on the basis of LDCE. Once this is done there will not be any justification of 19% examination for IP line official. Hence department should do away with this examination system which is otherwise also giving rise to litigations.





In the last but not least I ask you to take immediate step to implement the second cadre review recommendations. The members of the association have repeatedly proved their true commitment to various policies and programmes of the department by ensuring its successful implementation but the department is not sincere toward its demands. The associations has reasons to believe that the Deptt has already seized of this issue and fervently hope that the hurdle imported only to shuttle the implementation of second Cadre Review be removed by the present postal board so that things may not go beyond control of association. In such circumstances the department will be utterly responsibility.The implementation of these orders is the only way to avoid confrontation between IP/ASP cadre and the department. The members of the association have lost their patience as such their patience has been tested to the last extent. All the members are feeling otherwise and are asking to resort to initiate union action.

Sub: Child Care Leave to Central Government employees - regarding





The undersigned is directed to say that subsequent to issue of this Department OM of even number dated 07/09/2010, this Department has been receiving references from various Departments, seeking clarifications. The doubts raised are clarified as under:-





1. Whether Earned Leave availed for any purpose can be converted into Child Care Leave? How should applications where the purpose of availing leave has been indicated as 'Urgent Work' but the applicant claims to have utilized the leave for taking care of the needs of the child, be treated?

Child Care Leave is sanctioned to women employees having minor children, for rearing or for lo Coking after their needs like examination, sickness etc. Hence Earned Leave availed specifically for this purpose only should be converted.





2. Whether all Earned Leave availed irrespective of number of days i.e. less than 15 days, and number of spells can be converted? In cases where the CCL spills over to the next year (for example 30 days CCL from 27th December), whether the Leave should be treated as one spell or two spells'?

No. As the instructions contained in the OM dated 7.9.2010 has been given retrospective effect, all the conditions specified in the OM would have to be fulfilled for conversion of the Earned Leave into Child Care Leave. In cases where the leave spills over to the next year, it may be treated as one spell against the year in which the leave commences.





3. Whether those who have availed Child Care Leave for more than 3 spells with less than 15 days can avail further Child Care Leave for the remaining period of the current year'?

No. As per the OM of even number dated 7.9.2010, Child Care Leave may not be granted in more than 3 spells. Hence CCL may not be allowed more than 3 times irrespective of the number of days or times Child Care Leave has been availed earlier. Past cases may not be reopened.





4. Whether LTC can be availed during Child Care Leave?





LTC cannot be availed during Child Care Leave as Child Care Leave is granted for the specific purpose of taking care of a minor child for rearing or for looking after any other needs of the child during examination, sickness etc.

Reference in invited to this Directorate letter No. even dated 14th Jul 2009 on the subject cited above which provided for the manner of filling up of GDS vacant posts in single handed branch offices and branch post offices having two or more hands.

2. Provisional appointment for a brief may be resorted to only on account of sudden death, dismissal, removal, put off duty, absorption against the departmental post of Gramin Dak Sevaks and unauthorized absence for long period in case regular arrangements cannot be made immediately.

3. In the case of posts falling vacant due to discharge form service of the GDSBPM or absorption of the GDSBPM on the regular departmental posts, efforts should first be made to fill up the posts by adjusting identified surplus GDS fulfilling the prescribed qualification & other prescribed conditions failing which action should be taken in advance to fill the vacant post of GDSBPM on a regular basis by following the prescribed procedure and following other conditions prescribed under letter No. 17-103/2007-GDS dated 14 Jul 2009. The list of all the GDS, category wise, due to be discharged from service in calendar year may also be displayed on the Department's website in the month of January of each calendar year.
