Sub : Amendment in constitution of All India Association of Inspectors and     Assistant Superintendents Posts.
Sir,
          I am directed to refer to your letter No. CHQ/IPASP/Reso/1-2/2012 dated 17.5.2012 on the above mentioned subject and to inform that Government has provisionally approved amendment to the Constitution of All India Association of Inspectors and Assistant Superintendents Posts. The amended version will now read as given below.
Revised Article 38 : Subscription
The monthly subscription shall be Rs. 50/- (Rupees Fifty only) per member, payable monthly through check off system by deduction from the salaries by Drawing and Disbursing Officers (DDOs) @ Rs. 50/- (Rupees Fifty only) per month. However, in case of new members, they can exercise their option in the month of April and deduction of subscription @ Rs. 50/- (Rupees Fifty only) per month will be made by the DDO concerned from 1st July of that year. Entire deducted subscription will be remitted to the Circle Branch. 40% of the subscription will be allocated to CHQ and the remaining 60% to Circle Branch (by Circle Secretary).

Revised Article 44 : Circle Conference :
The Circle Conference shall be the supreme deliberative and legislative body of the Circle Association, it shall among others have following specific powers:
(a)          To elect the following office-bearers:
(i)           President                        (v) Organising Secretary – 4
(ii)          Vice President -2            (vi) Treasurer
(iii)        Circle Secretary              (vii) Assistant Treasurer
(iv)         Assistant Circle Secretary-3
Note : 1        The election of office-bearers at items (i) to (vii) above shall be by  secret Ballot, if so demanded even by a single member.
Note : 2        (a) If the Circle Conference of a particular Circle desires to have more  Organising Secretary or Assistant Circle Secretary they may be so elected.
(b)  To appoint the auditor from among the members.
(c)  To elect the members of the Circle Working Committee not exceeding twenty five.
(d)  To elect the delegates for the All India Conference.
(e)  To consider and adopt the annual report, accounts and budget estimates.
(f)   To adopt resolutions on problems of the members and to devise ways and means to implement the Center’s Policy Directives.
2.       The above amendment may be incorporated in the existing constitution of the Association and a fresh copy of the constitution submitted to this office for record.

O R D E R (Oral)
By Hon'ble Mrs. Shyama Dogra, Member (J):-

1.         This is a second round of litigation by the applicant for quashing of impugned order Annexure A-1 dated 30.8.2011 whereby, her request to grant her child care leave has been rejected by the respondents.

2.         The claim of the applicant is that Govt. of India issued office memorandums dated 11.9.2008 and 07.9.2010. Under those memorandums, women employees having minor children are to be granted Child Care Leave (CCL for short) for a maximum of two years during their entire service period for taking care of up to two children till the age of 18 years for the purpose of their care and taking care of any of their needs like examinations, sickness etc.  It is submitted by the learned counsel for the applicant that the applicant has twins, who are pursuing their studies in 10+1, Non-Medical.  Since the husband of the applicant is posted at a far-away place in Amritsar, the applicant has to look after these two children, therefore, she had applied for child care leave, which has been denied by the respondents by passing a          non-speaking order.  Aggrieved by that order, the applicant had filed an O.A and her case was remanded to the respondents to re-examine the matter afresh and pass speaking orders.  Impugned order annexure A-1 is an outcome of those directions given by the Court.

3.         While challenging this impugned order, the main contention of the applicant is that since these office memorandum are for the purpose of giving some relief to eligible women employees to enable them to look after their children properly, therefore, the respondents should not have rejected her request for CCL, keeping in view the fact that earlier also she was granted this leave for three months when the applicant had to look after her children during their final examination.  It is not denied by the applicant that this special child care leave cannot be claimed as a matter of right, yet the fact remains that this leave is to be granted for a particular purpose as mentioned in these instructions, therefore, if the applicant is not granted this leave the whole purpose of this scheme formulated for the benefit of women employees will be defeated.  The learned counsel for the applicant submits that the applicant will not be able to take this leave after 2013 as her children will become major by that time and their exams would be over.

The learned counsel for the applicant has also objected to the findings given by the competent authority with regard to shortage of staff in Chandigarh Postal Division on the ground that earlier also the applicant was posted to other post offices in Sector 36 and sector 44 which falsify the plea of the respondents that there is a shortage of staff as the applicant at present also is working in sector-15 Post office. She has categorically mentioned that out of the total strength of 486 permanent posts of postal assistants, 455 postal assistants are on the rolls, hence there is no shortage of staff and in case she is granted CCL, there is still a provision for appointment of an incumbent against a leave vacancy and the respondents can make necessary arrangements for such period for which the applicant has applied for CCL.

5.         The respondents have filed a written statement and have supported the impugned order on the ground that the applicant has not exhausted all the departmental remedies before coming to this Court, therefore, this O.A. is premature and liable to be dismissed as she can still file a representation to the higher authority against the impugned order Annexure A-1. The respondents have also categorically mentioned that grant of CCL cannot be asked for as a matter of right by the women employees and it can only be granted under special circumstances and she was also granted this leave during the final examination of her children and therefore, it cannot be said that the respondents are not considerate to women employees in the matter of grant of CCL.  The plea of the applicant for grant of this leave has been rejected by the competent authority in view of the instructions of DOPT dated 18.11.2008 (R/2) in the interest of smooth functioning of the office and keeping in view that if CCL is granted in routine, then the office work would suffer in various departments.  Since the applicant has not mentioned any valid reason for grant of this leave, therefore, there is no illegality in passing of the impugned order Annexure A-1, which is fully supported with reasons and the same is liable to be upheld.

6. The applicant has filed a rejoinder and reiterated the submissions as made in the O.A.

7. We have heard the learned counsel for the parties and carefully gone through the record. 

8. The instructions issued by the respondents on 11th September, 2008 and clarifications issued later on, clearly envisage that CCL cannot be demanded as a matter of right but the fact remains that this benefit has been given to the women employees to facilitate them so that they can devote adequate time to the care of their minor children upto the age of 18 years, which may be for the purpose of their up-bringing to look after any of their specific needs like examinations, sickness etc.  This leave can be granted for a maximum of 3 spells in a year. 

9. Therefore, once a particular scheme is introduced by the employer for the benefit of its employees, it should be implemented in a fair and rational manner and we are of the view that the respondents need not have completely rejected the request of the applicant for CCL as she needs this leave for the purpose of devoting some extra time to her minor children. Instead of completely rejecting her request, the respondents should have considered sympathetically her prayer for grant of CCL around the examination time. 

10. Therefore, in our considered opinion, the matter requires re-examination. Thus, the impugned order dated 30.8.2011 (Annexure A-1) is hereby quashed and set aside while giving directions to the respondent concerned to consider sympathetically the prayer of the applicant for grant of CCL in different spells  during and around the examination period of her children.  Needful be done within a period of two months from the date of receipt of a copy of this order.

11.  With these directions as above, this O.A. stands disposed of with no orders as to costs.

Exemption of Salaried Employees from Requirement of Filing of Returns for Assessment Year 2012-13

आकलन वर्ष 2012-13 के लिए रिटर्नों को भरने की आवश्‍यकता से वेतन भोगी कर्मचारि‍यों को छूट
केन्‍द्रीय प्रत्‍यक्ष कर बोर्ड (सीबीडीटी) ने दिनांक 17 फरवरी, 2012 की अपनी अधिसूचना संख्‍या 9/2012 के द्वारा आकलन वर्ष 2012-13 के लिए रिटर्नों को भरने की आवश्‍यकता से वेतन भोगी कर्मचारि‍यों को छूट दी है। उक्‍त छूट तभी लागू होगी जबकि निम्‍नलिखित सभी शर्तें पूरी कर दी जाती हैं:-

कर्मचारी ने केवल वेतन से आय तथा बचत बैंक खाते से आय प्राप्‍त की हो तथा बचत बैक खाते से अर्जित किया गया वार्षिक ब्‍याज 10 हजार रुपये से कम हो।

कर्मचारी की कुल आय 5 लाख रुपये से अधिक ना हो (कुल आय से आशय सकल कुल आय इसमें अध्‍याय VI ए के अधीन कटौतियां घटाएं)
कर्मचारी ने अपना पीएएन नियोक्‍ता को रिपोर्ट किया हो।

कर्मचारी ने बचत बैंक खाते पर मिले ब्‍याज से हुई आय को नियोक्‍ता को सूचि‍त किया हो।

कर्मचारी ने अपने नियोक्‍ता से फार्म 16 प्राप्‍त कर लिया हो।

टीडीएस के तौर पर कर्मचारी की कुल कर देयताएं नियोक्‍ता द्वारा चुकता कर दी गई हों तथा नियोक्‍ता ने टीडीएस को केन्‍द्रीय सरकार के पास जमा करा दिया हो।

कर्मचारी का रिफंड दावा ना हो।

कर्मचारी ने वेतन केवल एक नियोक्‍ता से प्राप्‍त किया हो।

• कर्मचारी ने आयकर विभाग से आयकर विवरण भरने की कोई नोटि‍स न प्राप्‍त की हो।

डाक विभाग को कंपनी का रूप देने का विचार

डाक विभाग की कमाई बढ़ाने और इसे बाजार प्रतिस्पर्धी को ध्यान में रखते हुए सशक्त बनाने बनाने के लिए दूरसंचार मंत्रालय निजी खुदरा कंपनियों, बैंक तथा शिक्षण संस्थानों से गठजोड़ कर विभाग का काम कंपनियों की तरह चलाने पर विचार कर रहा है। देशभर के लगभग 1.5 लाख डाकघरों को कंपनी के रूप में चलान से मंत्रालय को सेवा की गुणवत्ता में सुधार होने लाभ बढ़ने तथा लागत घटने की उम्मीद है।

 दूरसंचार विभाग के एक अधिकारी ने कहा कि मंत्रालय की डाकघरों को कंपनी रूप देने की योजना है, ताकि उन्हें जवाबदेह तथा लाभ में चलने वाला उद्यम बनाया जा सके। पिछले कुछ समय से डाक विभाग के राजस्व की स्थिति सही नहीं है और करीब 90 फीसदी उसका खर्च 1,55,000 डाक घरों में कार्यरत 4,75,000 कर्मचारियों के वेतन मद में जा रहा है। 

अधिकारी ने कहा कि कंपनी रूप देने की योजना के तहत दूरसंचार मंत्रालय 22 क्षेत्रीय प्रमुखों के लिए साल-दर-साल आधार पर 20 प्रतिशत राजस्व पैदा करने को अनिवार्य करने पर विचार कर रहा है। उसने कहा कि डाक विभाग को कंपनी रूप दिया जाएगा, लेकिन यह सरकार के नियंत्रण में होगा। योजना के तहत भारतीय डाक के 22 जोनों के लिए कमाई में साल दर साल 20 प्रतिशत वृद्धि का लक्ष्य रखा जाएगा। हालांकि डाक विभाग को 2010-11 में 6,954.09 करोड़ रुपये का राजस्व हुआ, जो 2009-10 के मुकाबले 11 प्रतिशत अधिक है, लेकिन छत्तीसगढ़ जैसे सर्किलों के राजस्व में गिरावट दर्ज की गई।

 डाक विभाग स्थिति में सुधार के लिए बैंक, बीमा एजेंसियों, शिक्षण संस्थानों तथा हिंदुस्तान लीवर और रिलायंस फ्रेश जैसी खुदरा कंपनियों से गठजोड़ करने पर विचार कर रहा है। 

अधिकारी ने कहा कि बैंक तथा खुदरा कंपनियों से गठजोड़ से विभाग को बेहतर राजस्व प्राप्त करने में मदद मिलेगी। 

दूरसंचार मंत्रालय डाक विभाग को अपने वृहत नेटवर्क का इस्तेमाल नरेगा, विशेष पहचान संख्या परियोजना तथा शिक्षण योजना जैसे सरकारी योजनाओं की पेशकश करने में भी निर्देश देने पर विचार कर रहा है। 

अधिकारी ने कहा, हमारा मकसद गांवों के गरीबों को बेहतर डाक सेवा देना है, जो आधुनिक बैंकिंग तथा खुदरा सेवा सुविधाओं से वंचित हैं तथा वित्तीय जरूरतों के लिए महाजनों पर निर्भर हैं।

डाक विभाग की आय 13 फीसद बढ़ी, घाटा कम हुआ



 
डाक विभाग के कामकाज में सुधार के संकेत हैं। विभिन्न वित्तीय सेवाओं से होने वाली आय की बदौलत पिछले वित्त वर्ष में डाक विभाग का घाटा 550.73 करोड़ रुपये कम हुआ है।

वित्त वर्ष 2011-12 में विभाग की कुल आय 13.62 फीसद बढ़कर 7,910.51 करोड़ रुपये हो गई जबकि व्यय 13,705.4 करोड़ रुपये रहा जिससे विभाग का कुल घाटा 5,794.89 करोड़ रुपये रहा। इससे पिछले वित्त वर्ष में विभाग को 6,345.62 करोड़ रुपये का घाटा हुआ था। छठे वेतन आयोग की सिफारिशों के लागू होने से डाक विभाग का घाटा तेजी से बढ़ा।

संचार एवं सूचना प्रौद्योगिकी मंत्री कपिल सिब्बल ने प्रेट्र से कहा ‘‘पिछले एक साल में हमने इंडिया पोस्ट को वाणिज्यिक और सामाजिक तौर पर व्यावहारिक बनाने की एकीकृत रणनीति बनाई है। पिछले साल के वित्तीय नतीजे से संकेत मिलता है कि हमें कुछ हद तक सफलता मिली है। लेकिन अभी बहुत कुछ करना बाकी है।’’

डाक विभाग द्वारा तैयार 2011-12 के वित्तीय प्रदर्शन की रपट के मुताबिक वित्तीय सेवाओं से आय 20.8 फीसद बढ़कर 4,304.07 करोड़ रुपये हो गई जो 2010-11 में 3,562.77 करोड़ रुपये थी। डाक परिचालन से आय 6.08 फीसद बढ़कर 3,606.44 करोड़ रुपये हो गई जो 2010-11 में 3,399.56 करोड़ रुपये थी।

सिब्बल ने कहा ‘‘चालू वित्त वर्ष के दौरान हमने 20 फीसद से ज्यादा आय का लक्ष्य रखा है। मुझे खुशी है कि इंडिया पोस्ट सही दिशा में बढ़ रहा है। अब हमें अपनी गति बढ़ाने की जरूरत है।’’ डाक विभाग ने इंडिया पोस्ट की प्रमुख सेवाओं के उचित कारोबारी ढांचा तैयार करने के लिए बोस्टन कंसल्टिंग ग्रुप को नियुक्त किया है।

CHQ President and GS visited Postal Directorate on 09.07.2012

President, General Secretary, Ex-General Secretary and Circle Secretary Punjab Circle visited the Postal Directorate on 9th July, 2012. They attended meeting on Organisational Restructuing in Department of Posts  called for by the Department. Views / suggestions already submitted on 4th June 2012 by our Association were discussed in length with the Committee. The approach of the Committee headed by the CPMG, M. P Circle was  positive towards IP/ASP cadre.
Following  issues were also discussed with the concerned officers during informal meeting :-
1. Amendment in the Constitution of All India Association of IP/ASP Association to revise Article 38 and 44.
    Orders are likely to be issued by the SR Division in this week.  
2. DPC for promotion to PS Gr. B.
    ACRs/APARs will be called for soon. Vacancies are yet to be calculated by SPG  Division..
3. Supplementary DPC for PS Gr. B for the year 2011.
    Postal Directorate will not convene supplementary DPC as regular DPC is already due.
4. Up-gradation of GP of IP from Rs. 4200/- to Rs. 4600/-.
     Representative from the Department has discussed the matter with the concerned officer in MOF. File is likely to be submitted again to the MOF.
5. PS Gr. B and PM Grade-I Examination for 2012.
     Results of both the examinations are likely to be declared soon.
6. Sr. PM Examination.
    Six CAT cases are pending in various benches. Hence, there is no hope for holding of  Sr. PM Examination in near future.

7. Periodical Meeting with the Secretary (Posts).
     Date of meeting will be fixed shortly by the Postal Directorate. Agenda for meeting has already been submitted to the Department on 10/4/2012.

Any promotions under LDCE shall not be brought into no. of promotions under MACP : Jodhpur CAT

v Promotion as PA from Group ‘D’/Postmen should not be construed as Promotion under MACP
v MACP shall be granted afresh from PA cadre based on 10, 20, 30 years in PA cadre
v Any promotions under LDCE shall not be brought into no. of promotions under MACP
v Applicant should be paid arrears with interest applicable to GPF


The full text of the judgment is furnished below in the link. What we are demanding all along (i.e) to exclude the promotions acquired by exam has been categorically declared by the Hon’ble judge. A remarkable decision.
